- General terms
1.1. These Purchase Terms (hereinafter ‘’terms’’) is legally binding document of both parties, in which the buyer and SIA ‘’Certex Latvija’’ registration no. 40003791169, address: Rītausmas iela 11b, Rīga, LV-1058 (hereinafter ‘’seller’’) rights and obligations, terms of purchase and payment of goods, procedure of delivery and return of goods, responsibilities of the parties and other terms related to purchase and sale of goods www. certex.lv online store (hereinafter ‘’online store’’).
1.2. The Buyer agrees to these Terms and undertakes to comply with them by clicking "REGISTER" to register in the Online Store and ticking "I have read and agree to the Terms of Purchase" at the time of purchase confirmation.
1.3. If the contract, including, but not limited to, the Law of the Republic of Buyer purchases goods through the website, then such mutual agreement is considered as a Distance Agreement and is in legal norms of the Republic of Latvia governing the distance Latvia Cabinet Regulations “Regulations on Distance Contracts” and are valid with the fulfillment of these regulations.
1.4. All individuals who have reached the age of 18 (eighteen) and legal entities have the right to make purchases in the online store. 1.5. All orders under 30 EUR (excluding VAT) are subject to Small Order Surcharge – 10 EUR + VAT
1.6. These terms shall be deemed to apply unless otherwise agreed in writing.
- Making a purchase
2.1. The prices and specifications of the goods sold in the online store are indicated next to the products on the www. certex.lv website.
2.2. To place an order, select desired products and add them to the shopping cart. Fill in all required fields, select most suitable delivery and payment method. Total cost of the order with VAT and delivery cost will be calculated after chosing the delivery method and finishing up the purchase. After making the payment, our warehouse will start packing your order and once it is ready you will receive an email from Certex Latvija Client service with information about pick-up or courier delivery, depends on chosen way of delivery.
3.3. All orders are stored in the Online Store and in the Seller's database in accordance with their Privacy Policy.
- Rights and obligations of the buyer
3.1. When ordering goods, the Buyer must indicate the delivery method of goods.
3.2. The Buyer undertakes to pay for the goods and the delivery (if applicable), as well as other payments (if such are indicated when placing the order) within 3 (three) working days to fully complete the order.
3.3. When purchasing goods, the Buyer must follow all the instructions in the User Manual and use products in strict accordance with the provided instructions for use. Failure to comply with these terms and conditions shall not result in the Seller's liability for damage to the product, the level of security, as well as the loss of the Product warranty.
3.4. Buyer has the right to refuse the goods in accordance with Article 7.1. described in Return Policy paragraph.
3.5. In point 3.3. The Buyer's rights provided in the Agreement are in accordance with the Consumer Rights Protection Law of the Republic of Latvia (PTAL) and Regulations No. 207 of the Cabinet of Ministers of the Republic of Latvia "On Distance Contracts".
3.6. The buyer is responsible for the accuracy of his data. If the Buyer's data included in registration form changes, they must be updated immediately.
3.7. The buyer undertakes not to pass on his login information to third parties. If the Buyer loses the connection information, he must immediately notify the Seller by the contact options indicated in the section "Contacts"
- Rights and obligations of the seller
4.1. The Seller is obliged, in accordance with these Terms, to process the order, inform the buyer about order status and to deliver the ordered goods to the specified address, if such option was chosen.
4.2. The Seller has the right to cancel the Buyer's order if the Buyer does not pay for the goods within 3 (three) working days.
4.3. If the Buyer tries to harm the operation of the Online Store or does not fulfill its obligations, the Seller has the right to immediately and without prior notice, restrict or suspend the possibility to use the Online Store, or in exceptional cases cancel the Buyer's registration
- Terms of payment for goods
5.1. The prices of the goods in the Online Store are indicated in euros without VAT, delivery and cable cutting costs, the total costs of the order with VAT, delivery and other costs will be calculated when finishing up the purchase
5.2. Payment for the goods is possible by choosing one of the following payment methods:
5.2.1. Payment using Swedbank, SEB, Citadele or Luminor internet banking indicated on the Online Store (this payment is provided by the payment platform makecommerce.lv, Maksekeskus AS);
5.2.2. Visa / Mastercard card payments indicated on the Online Store (this payment is provided by the payment platform makecommerce.lv, Maksekeskus AS);
5.2.3. Payment by bank transfer according to the prepayment invoice.
5.3. The distance agreement enters into force upon successful payment to the online store / company's bank account. If for any reason it is not possible to fulfill the order, the Buyer will be informed, and the paid amount will be fully refunded, not later than within 14 days after the notification.
5.4. If the Buyer has not made the payment according with the terms of payment in the invoice and the payment has not been confirmed, or the Seller has not been individually notified by e-mail that the payment has been made, the Seller is entitled to consider that the Buyer withdraws from the Distance Agreement and cancels the order
- Terms of delivery
6.1. The goods are delivered within the territory of Latvia.
6.2. The seller gives out or delivers the goods, only after receiving payment confirmation of the order and costs within it.
6.3. SIA “Certex Latvija” offers the following delivery methods:
6.3.1. In stock goods are delivered by courier by buyers specified address within 2 – 3 working days after the payment of the invoice.
6.3.2. In stock goods are delivered to the buyers selected DPD parcel terminal within 2 – 3 working days after the payment of the invoice.
6.3.3. The goods can be received in the warehouse of SIA “Certex Latvija”, Rītausmas Street 11b, Riga, LV-1058.
6.4. Goods that are not available in the warehouse are delivered in accordance with the delivery terms indicated in the product descriptions and the chosen delivery method.
6.5. The buyer, at the time of delivery of the goods, together with a representative of the transport company must check the condition of the package and goods.
6.6. If packaging or goods are damaged, or the quantity of the products does not correspond to the transport document, the buyer shall make a confirmation note on the transportation documents. If discrepancies in the quantity or assortment of goods are found after opening the package, the Buyer shall contact the Seller with this case by e-mail info@certex.lv, or by phone: 67611882 and follow the Seller's instructions.
6.7. If the Seller is unable to deliver the goods on time or provide exactly ordered products by the Buyer, the Seller's obligation is to offer a similar product and if the Buyer does not accept the goods, the Seller undertakes to return the money to the Buyer within 14 (fourteen) business days.
6.8. If the Buyer cancels the ordered goods during the delivery without a valid reason, the Buyer himself arranges the delivery of the goods to the Seller and bears the costs thereof.
- Product return
7.1. The Buyer has the right to cancel the Distance Agreement with the Seller in the Online Store and receive all the amount paid for the goods, if the requirements for returning the goods are met:
7.1.1. No more than 14 days have elapsed from the date of receiving the goods;
7.1.2. The product is standard, complete and not damaged, not used and has no change in its appearance;
7.1.3. The product is returned in the original packaging as it was delivered to the buyer;
7.1.4. Proof documents of the purchase are available (invoice, transportation documents).
7.2. If return requirements above are met, then the Buyer:
7.2.1. Notify the Seller in writing (indicating name, surname or company name; address; telephone number; e-mail address; bank account number to which the money paid should be transferred; order number, date and goods to be returned) by e-mail. mail: info@certex.lv or by filling in the return form, indicating the order number and date
7.2.2. No later than within 14 days after sending the withdrawal form, deliver the goods to the Seller at the address SIA “Certex Latvija”, Rītausmas iela 11b, Rīga, LV-1058.
7.3. The Buyer cannot breach the Distance Agreement concluded in the Online Store with the Seller if:
7.3.1. The goods were manufactured or delivered specially - in accordance with the Buyer's special requirements or conditions (for example, cut ropes and chains, specially made products (chain slings, rope slings), special orders not stored in the Seller's warehouse time is more than 2-3 dd) and are delivered only if they are ordered by the Buyer);
7.3.2. In other cases when the Distance Agreement cannot be withdrawn, in accordance with the legislation of the Republic of Latvia.
7.4. After returning the product, the Seller shall inspect the product within 14 calendar days and determine whether the product complies with the return requirements.
7.4.1. If the goods meet the return requirements, the Seller shall, within 14 (fourteen) days after receipt of the confirmation of the goods' compliance with the return requirements, transfer 100% of the paid amount to the Buyer's bank account number from which the payment was made, less delivery costs;
7.4.2. If the goods do not meet the return requirements, are damaged or are not complete, the Seller has the right to refuse to return the goods.
7.5. When returning a product that does not correspond to the ordered product or is a low-quality product, the Seller undertakes to accept such goods and exchange them for similar goods, but if the Buyer does not agree - return 100% of the money, including delivery costs
- Warranty
8.1. All goods sold in the Online Store have a two-year warranty against factory defects (factory defects). The guarantee is granted to legal entities for 1 year. The warranty takes effect from the date of sale (from the moment the invoice is issued).
8.2. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the elimination of defects in the goods or the exchange for new goods free of charge.
8.3. If it is not possible to eliminate the defect of the product or replace it with a new one, then the Seller undertakes to return the money paid by the Buyer within 14 (fourteen) working days, including delivery costs.
8.4. The warranty does not apply if:
8.4.1. If the product is made according to the customer's special requirements and the customer is informed about the non-compliance of the product with the applicable requirements
8.4.2. The product is made of the customer's material (without documents of origin).
- Processing buyer’s personal data
9.1. Any information related to personal data which is registered in the online store "www.certex.lv" is processed by the Seller in accordance with the Privacy Policy. In order to register in the Online Store, the Buyer must read the Privacy Policy and mark “I have read and agree to Certex Latvia Privacy Policy ”.
9.2. Personal data required for payments is transferred to the licensed payment institution Maksekeskus AS
9.3. The Seller may transfer personal data (Buyer's name, surname, address, telephone number) to the transport service provider to ensure the delivery of goods, if chosen.
- Disagreement settlement procedure
10.1. These regulations have been made in accordance with the legislation of the Republic of Latvia
10.2. In situations that are not mentioned in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.
10.3. All disagreements regarding the fulfillment of these terms and conditions between the Buyer and the Seller are resolved through negotiations or correspondence. If both parties are unable to resolve disputes through negotiations, disputes shall be resolved in accordance with the procedures provided for in the regulatory enactments of the Republic of Latvia
- Information transfer
11.1. The Seller sends all messages to the e-mail specified by the Buyer in the registration form
11.2. The Buyer sends all messages and questions to the address specified in the "Contacts" section of the Seller's Online Store
